Moving Shadow Ltd (“us”, “we”, or “our”) operates the movingshadow.com website, related RSS feeds, media content and APIs (the “Moving Shadow Core Services”).

This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use Moving Shadow Core Services and the choices you have associated with that data. We minimize the use of personal data to just the information necessary to provide and improve Moving Shadow Core Services. By using Moving Shadow Core Services, you agree to the collection and use of information in accordance with this policy.

Moving Shadow Core Services are for a general audience, are not targeted to children, and do not knowingly collect personal information from children under 18 years of age.

This page also informs you of our policies regarding the collection, use, and disclosure of personal data when you use Moving Shadow Optional Services and the choices you have associated with that data.

By using Moving Shadow Optional Services, you agree to the collection and use of additional information in accordance with this policy. Collectively, these two services are known as “Moving Shadow Services”.

Definitions

Moving Shadow Core Services

Moving Shadow Core Services means the movingshadow.com website, related RSS feeds, media content and API operated by Moving Shadow Ltd.

Moving Shadow Optional Services

Moving Shadow Optional Services means any additional services that may be listed here from time to time, operated by Moving Shadow Ltd.

Moving Shadow Services

Moving Shadow Services means the combined “Moving Shadow Core Services” and “Moving Shadow Optional Services” as listed above and will be used below when applicable to both services for clarity.

Moving Shadow Social Media

Moving Shadow Social Media means the combined and various official social media accounts on platforms such as Facebook, X (formerly Twitter), YouTube, Instagram, TikTok, etc.

Personally Identifiable Information

Personally Identifiable Information means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession).

Usage Data

Usage Data is data collected automatically either generated by using Moving Shadow Services or from Moving Shadow Services infrastructure itself (for example, the duration of a page visit or an IP address).

Cookies

Cookies are small pieces of tracking data stored on your device (computer or mobile device).

Data Controller

Data Controller means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and how any personal information is or is to be processed. For this Privacy Policy, we are a Data Controller of your Personally Identifiable Information.

Data Processor (or Service Provider)

Data Processor (or Service Provider) means any natural or legal person who processes the data on behalf of the Data Controller. We may use various Service Provider services to process your data more effectively or provide our services.

Data Subject (or User)

Data Subject means any living individual using Moving Shadow Services and is the subject of Personally Identifiable Information.

We collect several different types of information for various purposes to provide and improve Moving Shadow Services to you.

  2. Payment Data

    You may need to provide certain financial information, like your credit or debit card information, in order to facilitate the processing of payments for good or services provided by Moving Shadow Services. Although a purchase may be made on our website, your financial information is collected and stored by a third-party payment processing company and the use and storage of that data are governed by the third party’s applicable privacy policy. Moving Shadow has no access to your credit or debit card number or other financial information other than the payment date and amount.

    Personally identifiable information related to a transaction, including your first and last name, address, city, state, and zip code, may be shared between us and third parties to facilitate a transaction.

  3. Usage Data

    We may also collect information on how Moving Shadow Services is accessed and used (“Usage Data”). This Usage Data may include information such as your computer’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of Moving Shadow Services that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

    We do not try to identify individuals or otherwise collect Identifiable Information from IP addresses or web log information. IP addresses and web log information are used by Moving Shadow to, among other things, administer the Site, help diagnose technical problems, track and analyse aggregate data associated with the Site, design the Site and identify popular features.

    We may aggregate IP addresses and/or weblog information, and may store, analyse, manipulate, display, disclose, distribute, retain, and otherwise use such non personally identifiable information. We may also provide IP addresses and/or weblog information to law enforcement agencies if someone tries to damage Moving Shadow Services or use them in an unauthorized or illegal way.

  4. Tracking Cookies Data

    We use cookies and similar tracking technologies to track the activity on Moving Shadow Services and hold certain information.

    Cookies are files with a small amount of data that may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyse Moving Shadow Services.

“Do Not Track” Disclosure

The Site does not currently take steps to respond to browsers’ “Do Not Track” signals as no uniform standard to respond to such signals has been developed at this time.

Moving Shadow Ltd uses the collected data for various purposes:

  • To provide and maintain Moving Shadow Services
  • To provide support for Moving Shadow Services
  • To gather analysis or valuable information so that we can improve Moving Shadow Services
  • To monitor the usage and security of Moving Shadow Services
  • To detect, prevent and address technical issues

We also use the collected data to deliver relevant ads to you when you use Moving Shadow Services. As noted above, third-party advertising networks and advertisers may use cookies and similar technologies to collect and track information such as demographic information, inferred interests, aggregated information, and activity to help them deliver advertising that is more relevant to your interests. If you are a Moving Shadow Optional Services user, Moving Shadow may periodically send promotional materials or notifications via “Moving Shadow Social Media” accounts. If you want to stop receiving promotional materials, you can follow the unfollow or unsubscribe instructions in the relevant social media service. We do not store the content posted on these services. For privacy policies and terms of use, refer to the social media service in question.

If you have subscribed to a Moving Shadow Newsletter service, you can follow the unsubscribe instructions at the bottom of each email.

You have a right to review and request changes to any personally identifiable information that Moving Shadow collects from you. To review or request changes, follow the instructions at the bottom of each email or contact us at [email protected], Subject: PII Change Request. Please note that we may require you to verify your identity via postal mail for your data security and protection. Valid, identified requests will receive a response.

General Data Protection Regulation (GDPR) Compliance

Moving Shadow seeks to fully comply with the European Union’s GDPR. Pursuant to this regulation, you have the following rights:

  • Right to be forgotten: You may cancel any account held with a Moving Shadow Service at any time. If you wish your data to be permanently deleted, you may contact us at [email protected], Subject: PII Removal, and it will be deleted within 72 hours.
  • Right to object: We have never performed any data science projects on user data and do not anticipate doing so in the future. If at any point this should change you will be notified in writing. You may remove your contact data from any such project by emailing us at [email protected], Subject: Opt Out of Data Science.
  • Right access and rectification: You can contact us at [email protected], Subject: Access Request, at any time to access copies of all user data we retain from you. We will remove, update, or change any personal information about you from our servers immediately upon your request.
  • Right of portability: We only retain your name and email address. Nevertheless, we will provide that information to you upon request.

In addition to the above, an “unsubscribe” option is automatically included in the footer of every email/newsletter. In the event you unsubscribe, we will immediately stop sending you further editions. Please understand that unsubscribing from our newsletter does not cancel other Moving Shadow Service memberships. In order to do so, please login to the relevant account and cancel it there.

Retention of Data

Moving Shadow Ltd will retain your Personally Identifiable Information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personally Identifiable Information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Moving Shadow Ltd will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter time, except when it is used to strengthen the security or improve Moving Shadow Services’ functionality. We are legally obligated to retain this data for longer time periods.

Transfer of Data

Your information, including Personally Identifiable Information, may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those from your jurisdiction.

If you are located outside the United Kingdom and choose to provide information to us, please note that we transfer the data, including Personally Identifiable Information, to the United Kingdom and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Moving Shadow Ltd will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personally Identifiable Information will take place to an organization or a country unless there are adequate controls in place, including the security of your data and other personal information.

Disclosure of Data

Business Transaction

If Moving Shadow Ltd is involved in a merger, acquisition, or asset sale, your Personally Identifiable Information may be transferred. We will provide notice before your Personally Identifiable Information is transferred and becomes subject to a different Privacy Policy.

Disclosure for Law Enforcement

Under certain circumstances, Moving Shadow Ltd may be required to disclose your Personally Identifiable Information if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).

Moving Shadow Ltd may disclose your Personally Identifiable Information in the good faith belief that such action is necessary to:

As we do not provide user accounts or profiles with Moving Shadow Core Services, you can only access, update or request deletion of your Personally Identifiable Information by contacting us to assist you. If you are a Moving Shadow Optional Services user, you may delete your account or unsubscribe from the services or contact us to assist you.
  • The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.
  • The right to object. You have the right to object to our processing of your Personally Identifiable Information.
  • The right of restriction. You have the right to request that we restrict the processing of your personal information.
  • The right to data portability. You have the right to be provided with a copy of the information we have on you in a structured, machine-readable, and commonly used format.
  • The right to withdraw consent. You also have the right to withdraw your consent at any time where Moving Shadow Ltd relied on your consent to process your personal information.

Please note that we do not attempt to tie IP address information to individual users as part of our processing of Usage Data for Moving Shadow Services.

You may be required to provide proof of ownership of an IP address from the relevant ISP at each time of use for each removal if you wish us to remove IP address information from our records. This is to protect the privacy of other users information as multiple users can share IP addresses.

However, IP address data is only collected for as long as necessary for Moving Shadow Services’ security, and access to the IP information is restricted to the appropriate administrators and service providers.

Please note that we may require you to verify your identity via postal mail for your data security and protection. Valid, identified requests will be responded to within the 30-day requirements of the GDPR upon receipt of the request. Contact [email protected] for more information.

You have the right to complain to a Data Protection Authority about our collection and use of your Personally Identifiable Information. Please contact your local data protection authority in the European Economic Area (EEA) for more information.

Service Providers

We may employ third-party companies and individuals to facilitate Moving Shadow Services (“Service Providers”), provide Moving Shadow Services on our behalf, perform Service-related services, or help us analyze how Moving Shadow Services are used.

These third parties may collect personally identifiable information about your online activities over time and across different websites when you subscribe to Moving Shadow or otherwise use our services.

We currently use CloudFlare (content delivery provider) and Scaleway (content delivery provider).

Analytics

We may use third-party Service Providers to monitor and analyze the use of Moving Shadow Services.

Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of Moving Shadow Services. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

You can opt-out of having your activity on Moving Shadow Services made available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity.

Advertising

We may use third-party Service Providers to show advertisements to you to help support and maintain Moving Shadow Services.

Google Ad Manager is an advertising service provided by Google.

Newsletter

As a part of the Moving Shadow Optional Services, and with your opt-in consent, we may use third-party Service Providers to send email newsletters and track their interaction to provide you with the newsletter.

MailerLite provides email marketing and automation software as a service.

Behavioural Re-marketing

We do not knowingly collect or request personally identifiable information from anyone under the age of 18. If we become aware that we have collected Personally Identifiable Information from children without verifying parental consent, we will take steps to remove that information from our servers.
